Teen Faces Jail Time After Humping Jesus Statue

In Pennsylvania a 14-year-old boy is now facing up to two years in a juvenile detention facility for a Facebook photo that he posted. The photo depicts him simulating oral sex with a Jesus statue.

This was an alleged prank, but one that has been taken seriously. In Pennsylvania, there is a law that was established in 1972, which criminalizes “defacing, damaging, polluting, or otherwise physically mistreating in a way that the actor knows will outrage the sensibilities of persons likely to observe or discover the action.”

The law is extremely broad in nature. However, the law is arguably in violation of the constitution because it infringes the Establishment clause, which states “Congress shall make no law respecting an establishment of religion.” 

A statue of Jesus is certainly an establishment of religion. Perhaps this will release the teen of the charges, but maybe not. 

Just remember that if you are in Pennsylvania, don’t hump Jesus, or at least don’t post it online!
